Terms of Service

By creating an account, purchasing a membership, or otherwise using AfterFive (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a notice on the platform before they take effect. Continued use of the Service following notice of changes constitutes acceptance.

You must be at least 18 years of age to create an account and purchase a membership.

You represent that: (a) you are at least 18 years old; (b) the information you provide is accurate; and (c) your use of the Service complies with these Terms and all applicable laws.

Certain venues listed on AfterFive serve alcohol and may have their own age requirements (typically 21+). AfterFive collects date of birth to help surface relevant content and age restrictions — we do not guarantee entry to any venue or event.

AfterFive is a private membership platform that provides curated venue and event discovery, a digital member pass, and access to member benefits offered by partner venues. AfterFive is a discovery and information platform only.

AfterFive does not own, operate, manage, or control any venue listed on the platform.

We do not make reservations on your behalf, guarantee availability, guarantee entry, or guarantee that any specific venue, event, or member perk will be available when you arrive. Venue hours, offerings, admission policies, and member benefits are subject to change at any time by the venue, with or without notice to AfterFive.

Information about venues (hours, events, specials, perks) is provided for informational purposes. We make reasonable efforts to keep listings accurate but cannot guarantee the accuracy, completeness, or timeliness of any venue information.

You are responsible for maintaining the security of your account credentials. You may not share your account with another person or allow others to access the Service using your credentials. You are liable for all activity that occurs under your account.

If you suspect unauthorized access to your account, notify us immediately at support@joinafterfive.com.

Access to the member app, Tonight feed, Explore, and member pass requires an active paid membership. Membership is billed on a recurring monthly basis via Stripe, our third-party payment processor. See our Membership Terms for full billing details.

AfterFive does not store your payment card details. All payment processing is handled by Stripe in compliance with PCI DSS standards.

You agree not to:

• —Use the Service for any unlawful purpose or in violation of any regulation
• —Share your account credentials with any third party or allow others to access the Service using your account
• —Attempt to gain unauthorized access to any part of the Service, any other account, or any system connected to AfterFive
• —Use automated tools, bots, scrapers, or crawlers to extract data from the Service
• —Post or transmit any content that is false, defamatory, obscene, threatening, or otherwise objectionable
• —Impersonate any person or entity or misrepresent your affiliation with any person or entity
• —Interfere with or disrupt the integrity or performance of the Service or the servers and networks connected to it
• —Attempt to circumvent any content-filtering, subscription, or access-control mechanism
• —Reproduce, redistribute, or resell any part of the Service or its content
• —Collect or harvest information about other members without their explicit consent

If you upload content to AfterFive (such as a profile photo), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content for the purpose of operating the Service. You retain ownership of your content.

You represent that you own or have the necessary rights to any content you submit, and that it does not violate the rights of any third party. We may remove any content that violates these Terms.

The AfterFive name, logo, brand, platform design, Tonight and Explore features, member pass, and all original content are owned by AfterFive and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the AfterFive name, logo, or brand for any purpose outside of normal use of the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AfterFive does not warrant that (a) the Service will be uninterrupted or error-free; (b) any venue listing, event, or perk will be accurate, complete, or available; (c) any member benefit will be honored by a partner venue; or (d) the Service will meet your expectations.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AFTERFIVE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL AFTERFIVE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO AFTERFIVE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless AfterFive and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any conduct we determine, in our sole discretion, to be harmful to AfterFive, other members, partner venues, or third parties.

You may close your account at any time. Closing your account does not entitle you to a refund for any prepaid subscription period. See our Refunds & Cancellation Policy.

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive your right to participate in class action litigation or class-wide arbitration.
